INTRODUCTION

Your agreement is between yourself (the "Client"), and Alvin Nurse (the “Trainer”). These Terms and Conditions form part of your agreement with the Trainer.

TRAINER

Your trainer is a fully qualified personal trainer (accredited with CIMSPA (Chartered Institute for the Management of Sport and Physical Activity) to at least Level 3).

TRAINER’S OBLIGATIONS

a.) The Trainer will use his/her skills and knowledge to design a safe programme of exercise that will consider your lifestyle, personal goals, fitness levels and medical history.

b.) The Trainer will provide the coaching, supervision, advice and support that you will need to achieve your goals.

c.) You understand that the results of any fitness programme cannot be guaranteed. Your progress depends on your effort and co-operation in and outside of the sessions. In particular, you acknowledge that individual results may vary, and no particular result is guaranteed by the Trainer.

d.) All Client information will be kept strictly private and confidential.

e.) Training sessions will be UP TO 45minutes in length, but may be less depending on completion of relevant activities.

YOUR OBLIGATIONS

a.) It is understood between you and the Trainer that both must commit to your training programme in order for you to achieve results.

b.) You are required to arrive on time for each session so that the Trainer’s full training plan is achieved on each visit.

c.) You are required to wear appropriate clothing and footwear.

d.) You are required to complete a Physical Activity Readiness Questionnaire (a “PARQ”) before undertaking your first personal training session, which will be sent through to the client following payment for the first session.

e.) The Trainer may require a letter of ‘medical clearance’ from your GP. Please be aware that your GP may charge for providing this letter.

f.) You understand and agree that it is your responsibility to inform the Trainer of any conditions or changes to your health, now and on-going, which may affect your ability to exercise safely and with minimal risk of injury.

g.) If your Trainer requires further medical information from a practitioner, you must provide such details.

h.) You understand that there are inherent risks in participating in a programme of strenuous exercise. If you sustain or claim to sustain any injury while participating in training, you acknowledge that the Trainer is not responsible, except where the injury was caused by his/her gross negligence or intentional act.

i.) The Trainer cannot be held liable in any way for undeclared or unknown medical conditions.

PAYMENT

a.) Payment for sessions must be made in advance.  

b.) Acceptable forms of payment are: by internet bank transfer, direct debit, cheque in advance or cash paid directly to the Trainer.

c.) Recurring subscriptions to ongoing coaching will be handled via GoCardless, Stripe  or another suitable online payment processor.

CANCELLATION AND REFUNDS

  1. a.) 24 hours’ notice of cancellation or rescheduling is required for all appointments.


    b.) Notice of less than 24 hours will result in full loss of the coaching session.

    c.) Unforeseen events will be taken into consideration on the day.

    d) Once purchased, your sessions are non-refundable.  

  2. a) For ongoing subscriptions, a minimum notice period of 30 days is required to cancel your subscription. You must provide this notice in writing (email is acceptable), and it must be received at least 30 days prior to your next billing date.

    b) Failure to provide notice within this time frame will result in the subscription being renewed for the following month. No refunds will be issued for late cancellation requests.

    c) If you cancel your direct debit or payment method without following the proper cancellation procedure outlined above, your program and access to all coaching materials will cease immediately, and you will lose access to any resources or content provided as part of the coaching package. Additionally, any outstanding balances for the subscription period will remain due and payable.

LATENESS POLICY

a.) If the Client is late the session cannot be extended and will end at the appointed time.

b.) If the Trainer is late additional time will be added to the session or to subsequent sessions.

HOLIDAY POLICY

a) The Trainer may be away on leave at various times throughout the year. They will ensure you have a suitable program to complete in their absence.

b) The Trainer will do their best, in conjunction with the Client, to rearrange any ongoing sessions, that fall within these periods, and the session will not be lost.

c) For the weeks you, the Client, are unable to make sessions the trainer will do their best to reschedule the missed sessions however if it is not possible within 1 month of your return, those sessions will be missed but still paid for.

GENERAL

a.) Your training may be filmed, or pictures taken for analysis and/or marketing purposes. Your permission to use these publicly will always be requested, and you reserve the right to deny this.
